The lawsuit centered around allegations of copyright infringement and cultural appropriation, claiming that MGA unlawfully used the OMG Girlz’s likeness for their popular doll line.
The Lawsuit Breakdown
Initially, in September 2024, a court awarded the Harrises a whopping $71 million, which included:
- $17.9 million in actual damages for common law misappropriation
- $53.6 million in punitive damages for reckless and harmful behavior
However, Judge James Selna later questioned the punitive damages, suggesting a drastic reduction to just under $18 million due to insufficient evidence of bad faith by MGA.
Judge Reverses Decision
After further review, Judge Selna reversed his earlier stance, reaffirming the full $71.5 million award. This reconsideration highlighted the severity of MGA’s actions, which the court ultimately deemed as reckless and culturally exploitative.
The lawsuit accused MGA of engaging in “cultural appropriation and outright theft” by profiting off the OMG Girlz’ brand without permission. T.I. and Tiny, who founded the OMG Girlz, argued that the dolls closely mirrored the group’s image, style, and essence, which played a significant role in the brand’s commercial success.
